This policy explains what personal data Avanti collects, why, who handles it and what rights you have. It covers the Avanti app for iPhone and Android and the Avanti website.

1. Who is responsible for your data

1.1 Avanti is published by Blue Fountain Interactive Ltd. In this policy "we", "us" and "our" mean that company. We are the "controller" of your personal data, which means we decide how and why it is used.

1.2 Our details:

1.3 Avanti is a programme of Night School by John Obidi.

2. The short version

3. What we collect

3.1 Data you give us or that the app records as you use it

DataDetail
Email addressThe address you type to sign in. It identifies your account.
Quiz answersIf you take the quiz on the Avanti website, it ends by asking for your email address. From that moment an account exists for that address, and your quiz answers are kept with it.
Profile detailsA first name, last name and username, if these are added to your account. They are optional.
Sign-in recordsEach time a sign-in code is requested we record the email address, the time, when the code expires, the number of wrong tries, when the code was used, and the IP address the request came from. We store a scrambled (hashed) copy of the code, never the code itself.
Lesson activityWhich lessons you start and finish, when, whether it was a replay, and the option you chose at each decision or question.
Decision profileHow each lesson you finished moved the traits on your profile, and the gems that go with them. This is worked out from your choices. See section 5.
RatingsThe stars you give a lesson, any tags you pick and any note you write.
"Curious what happens next?" answersYour answer (yes, maybe or no) at the end of a series episode.
FeedbackThe kind of feedback (a problem, a thought or a feature suggestion) and what you wrote.
Reminder settingWhether your daily reminder is on and the hour you chose. The reminder itself is set on your phone. See section 4.
Subscription recordYour plan, its status, the date the current period ends, how the access was obtained (a payment, a code, or access we gave you) and a reference number from the payment company.
Messages to supportAnything you send to our support email address, and our replies.

3.2 Technical data

3.3 Data kept on your phone

3.4 Payment data

Subscriptions are bought on the Avanti website. Your card or other payment details are typed into a form run by the payment company and are handled by that company. They never reach our servers, and we never see or store your full card number or security code. The payment company tells us that a payment succeeded, which plan it was for and the renewal date, and gives us its own reference for you as a customer.

3.5 What we do not collect

The app does not collect your location, contacts, photos, camera or microphone. It does not read an advertising identifier. It does not register your phone to receive push messages from our servers. There are no passwords, so we hold none. We do not ask for your date of birth.

3.6 Do you have to give us this data?

You need to give an email address to have an account. Without it we cannot sign you in or keep your progress. Everything else in section 3.1 either comes from using the app or is optional.

4. Reminders and notifications

4.1 The daily reminder is a notification that your phone gives itself. When you switch it on, the app asks your phone to show a reminder at the hour you chose. Our servers do not send it.

4.2 Your phone asks for your permission the first time you switch a reminder on. The app never asks when it first opens.

4.3 We copy your choice (on or off, and the hour) to your account as a record.

4.4 You can switch the reminder off in the app under Settings, then Notifications, or in your phone's own settings. Signing out switches it off on that phone.

5. Your decision profile

5.1 Your decision profile is worked out automatically. Each option in a lesson moves one or more traits a set amount in one direction. Your profile is the total of those moves from the first time you finished each lesson. Replaying a lesson does not change it.

5.2 The profile is for you. We do not use it to make decisions about you, and we do not use it for advertising.

5.3 We do not make any decision about you by automated means that has a legal effect on you or affects you in a similarly significant way.

6. Why we use your data, and our lawful bases

UK and EU data protection law requires us to have a lawful basis for each use of your data.

7. Who can see your data inside our company

Authorised people at our company can see, in a private admin area: the list of accounts (email address, name if given, the date the account was created, the number of lessons finished and the plan), and the ratings, answers and feedback that people send, shown with the sender's email address.

8. Who we share your data with

8.1 We use other companies to run Avanti. They handle your data on our instructions.

8.2 Payment companies. Payments are handled by two payment companies. Stripe handles payments by card and wallet. Paystack handles payments in naira and some other African currencies. They receive the details you type at checkout. They use some of that data for their own purposes, such as preventing fraud and meeting their legal duties, under their own privacy policies.

8.3 Apple and Google. You download the app from Apple's App Store or Google Play. Apple and Google handle your data under their own privacy policies. They may show us totals, such as the number of downloads. They do not tell us who you are.

8.4 Others. We may share data with our professional advisers, and with courts, regulators or the police where the law requires it. If Avanti or our company is sold or reorganised, your data may pass to the new owner, who must keep to this policy or tell you about any change.

8.5 We do not sell your personal data. We do not share it with advertisers. Other Night School products are run by the same company, but we do not pass your Avanti data to them.

9. Sending data to other countries

9.1 Blue Fountain Interactive Ltd is a United Kingdom company. Your personal data is processed in the United States and the United Kingdom, where the servers and the support mailbox we use are. Lesson films and pictures are stored in Western Europe and delivered by Cloudflare. So your data may be handled outside the country where you live.

9.2 Where the law requires a safeguard for sending personal data to another country, we rely on the UK International Data Transfer Agreement or Addendum, the European Commission's standard contractual clauses, or an adequacy decision.

9.3 You can ask us for more detail about the safeguard used for a particular company.

10. How long we keep your data

DataHow long
Account, profile details, quiz answers, lesson activity, decision profile, ratings, "Curious what happens next?" answers, reminder setting, subscription recordUntil you delete your account. They are then removed from our live database straight away. An account that has never been signed in to may be deleted after 12 months.
Sign-in records30 days. Those for your email address are also removed when you delete your account.
Feedback you sent through the appKept after you delete your account, but no longer linked to your account or your email address, for as long as it is useful for improving Avanti.
Messages to support2 years.
Payment, tax and accounting records6 years. The payment company keeps its own records under its own policy.
Server logsOnly for as long as we need them to find faults and keep Avanti secure.
BackupsUp to 30 days. A deleted account can remain in a backup until that backup expires.

11. Your rights

11.1 Under UK and EU data protection law you have the right to:

11.2 To use any of these rights, email support@tryavanti.io. Please write from the email address on your account, so that we know the request comes from you. We may ask for more information if we need to be sure who you are.

11.3 We reply within one month. Using your rights is free. The law allows us to take longer or to refuse in limited cases, and we will tell you if one applies.

11.4 You can delete your account yourself without writing to us. See section 12.

12. How to delete your account

12.1 In the app:

  1. Open the Profile tab and tap Settings.
  2. Tap Delete account.
  3. Type the email address on your account to confirm.
  4. Tap Delete my account.

12.2 Deleting is permanent and happens straight away. It removes your account, your profile details, your quiz answers, your lesson activity and choices, your decision profile and gems, your ratings and answers, your reminder record, your subscription record on our system and any sign-in records for your email address. The app then signs you out and switches off the reminder on that phone.

12.3 What is not removed straight away:

12.4 Deleting your account also cancels a subscription that renews, so the payment company does not charge you again. Your access ends straight away, including for a period you have already paid for. If you want to keep your access to the end of that period, cancel the subscription on the account page of the Avanti website instead and leave your account in place.

12.5 If you sign in again later with the same email address, you start with a new, empty account.

12.6 If you cannot use the app, email support@tryavanti.io from the address on your account and ask us to delete it. We will do so within one month.

13. Children

13.1 Avanti is not directed at children under 13. You must be at least 13 years old to use it.

13.2 We do not knowingly collect personal data from a child under 13. If we learn that a child under 13 has an account, we delete it. If you believe a child under 13 has an account, email support@tryavanti.io.

13.3 If you are aged 13 to 17, use Avanti only with the permission of a parent or guardian.

14. Cookies and similar storage

14.1 The app does not use cookies to follow you. It keeps the items listed in section 3.3 on your phone so that it can work.

14.2 The Avanti website uses one cookie, called nsl_session. It keeps you signed in on the account page for up to 30 days. It is needed for signing in to work.

14.3 The website uses no analytics cookies, no advertising cookies and no tracking cookies.

15. If you live in Nigeria

15.1 If you are in Nigeria, the Nigeria Data Protection Act 2023 applies to our handling of your personal data, alongside the rest of this policy.

15.2 The lawful bases in section 6 are also our lawful bases under that Act: performing our contract with you, meeting our legal duties, our legitimate interests and, for the daily reminder, your consent.

15.3 You have the rights listed in section 11: to be told how your data is used, to see it, to have it corrected or deleted, to limit or object to its use, to receive it in a form you can move to another service, and to withdraw consent where we rely on consent. To use any of these rights, email support@tryavanti.io.

15.4 Your data is stored and handled outside Nigeria, in the countries named in section 9. We send it there because we need to in order to provide Avanti to you, and we use the safeguards described in section 9.

15.5 If you pay in naira, your payment is handled by Paystack.

15.6 If you are under 18, you need the permission of a parent or guardian to use Avanti.

15.7 You may complain to the Nigeria Data Protection Commission. We would like the chance to put things right first, so please contact us.

16. If you live in California or another US state

16.1 We do not sell your personal information, and we do not share it for advertising, as the privacy laws of California and other US states define those words. We do not give it to other companies for their own direct marketing.

16.2 The rights listed in section 11 are available to you on request. Email support@tryavanti.io. We will not treat you differently for using these rights. You may ask someone you have authorised to make a request for you.

16.3 The kinds of personal information we collect are: identifiers (email address, IP address, account number), commercial information (your subscription record), activity in the app (lessons played, choices, ratings and feedback) and conclusions drawn from that activity (your decision profile). Section 6 explains why we collect each one and section 8 explains who handles it.

16.4 The app and website do not track you across other apps and websites, so they do not respond to "Do Not Track" signals from browsers.

17. Questions and complaints

17.1 Write to us first at support@tryavanti.io or at our registered office. We will confirm within 30 days that we have received your complaint, and we will reply without undue delay.

17.2 You may complain to the United Kingdom's Information Commissioner's Office:

17.3 If you live outside the United Kingdom, you may also complain to the data protection authority in the country where you live.

17.4 If you are in Nigeria, see section 15.7.

18. Changes to this policy

18.1 We will update this policy when what we do with your data changes, for example when we add a feature. We will post the new version on the Avanti website and change the date at the top.

18.2 If a change is significant, we will tell you by email or in the app before it takes effect.
